HAVE YOU BEEN MIS-SOLD BUSINESS ENERGY?

Determining whether you’ve been mis-sold a business energy contract can be challenging, especially since a lack of transparency from the energy broker may have contributed to the issue. It’s important to note that many business energy brokers operate in good faith, making recommendations based on your best interests. Simply using a broker doesn’t automatically mean you have grounds for a claim.

However, a key warning sign is if your energy broker or consultant did not provide a full written disclosure of how much they earned from your contract. This includes any commission or fees received from the supplier for recommending them to you, whether as a one-time charge or an ongoing cost.

If your broker wasn’t transparent about their earnings, there’s a possibility that these fees were hidden in your contract.

A business energy claim can apply to both past and current contracts, so even if you’re still in an active agreement, you may still be eligible to pursue a claim.

How can you make a business energy claim?

At Brightpath Energy, we’re here to assist you with business energy claims. Our specialised service helps you determine whether your contract was mis-sold and guides you through the claims process.

We will assess if your contract was arranged through an energy broker and identify any potential mis-selling.
To get started, we’ll need the following details:

• The date you signed your business energy contract, along with its start and end dates
• Your estimated annual gas or electricity usage
• The unit cost per kilowatt hour (kWh) for your gas and electricity
• Your business electricity distributor ID
• The profile code or class of your electricity meter
• The name of your business energy supplier
• The name of your energy broker, if known
• Your business details, including the number of meters

If you authorise us to proceed, we will contact your energy broker and supplier on your behalf. Should your case progress to a claim, it’s important to cooperate with our solicitor’s requests to ensure a smooth process.

How much do business energy claims cost?

Legal fees for your business energy claim will, of course, be based on which company you use. However, many of the legal firms and experts dealing with business energy claims operate on a ‘no win, no fee’ basis.
This means if your claim was unsuccessful, you likely wouldn’t pay any legal fees. If your claim is successful, meanwhile, the legal fees may be deducted from your overall compensation, depending on the terms of the agreement. We need to discuss this

Will the business energy claim go to court?

Most business energy claims are resolved through compensation without the need for court proceedings. However, in some instances, court action may be necessary. If your claim does go to court, Brightpath Energy will be there to provide you with full legal support throughout the process.

What will happen to my business energy contract?

Filing a business energy claim against your current supply contract could lead to a reduction in costs by having any hidden or inflated fees removed. Alternatively, you may be offered the option to cancel the contract and switch to a new supplier, the choice is yours !
